A. Original Artwork

All artwork sold on this website remains the intellectual property of the artist (Anchen Coetzee). Purchase of an artwork does not transfer copyright or reproduction rights. Artwork may not be copied, reproduced, resold, or used for commercial purposes without prior written consent from the artist.

Commissioned artworks are one-of-a-kind pieces created exclusively for the client and will not be reproduced, resold, or printed in any form, including prints or wholesale reproduction, in their original commissioned composition.

However, the artist retains the right to create new, similar works inspired by themes, styles, or subject matter, as individual landscapes, scenes, or concepts are not exclusive to any client.

The artist reserves the right to decline any commission or order at their discretion.

B. Shipping Costs

All local (South Africa) print orders are shipped at a flat rate of R120. Shipping for original artwork varies depending on size, weight and destination but starts at a R120.

C. International Shipping

International orders are welcome, however shipping costs cannot be automatically calculated at checkout. Shipping will be quoted separately based on the size, weight, and destination of the artwork. A follow-up invoice for shipping will be issued prior to dispatch.

Please note that the buyer is responsible for any customs duties, import taxes, or additional fees charged by the destination country. These costs are not included in the artwork price or shipping quote.

D. Shipping Address

It is the buyer’s responsibility to ensure that all delivery details provided are accurate and complete at the time of purchase. The artist cannot be held liable for delays, loss, or additional costs resulting from incorrect or incomplete address information.

Risk transfers to the buyer once the artwork has been handed to the courier. However, in the event that a fine art print is damaged during transit, the artist may provide a replacement upon receipt of photographic evidence, provided the damage is reported within 48 hours of delivery.

E. Local Collections

Local collection is available between Thursday to Saturdays, from 09:00 to 14:00. Collection instructions and location details will be provided in the invoice once the order is ready for collection.

Upon arrival, buyers are required to contact the artist via WhatsApp: [insert number].

Please note that collection days and times are subject to change based on availability. Any changes will be communicated in advance, and updated information will be reflected on the website where applicable.

F.  Commissions Process and Disclaimers

1. You complete the commission request form, and I will respond within 1-3 business days.
2. If your request is accepted, an invoice for a 50% non-refundable deposit will be issued. Payment is made via EFT.
3. Once the deposit has been received, please send proof of payment to hello@artbyanchen.com with the subject line: “Full Name - Commission POP”.
4. I will create an initial sketch based on your reference images. Two rounds of minor revisions are included at the sketch stage. Additional revisions may incur extra costs and may also affect the overall timeline.
5. Once the sketch is approved and finalised, and any agreed feedback has been incorporated, I will begin the painting process.
6. Progress updates and completion images will be shared for final approval.
7. The remaining 50% balance will be invoiced upon completion. This final invoice will include shipping costs, calculated based on size, weight, and destination.
8. Once full payment has been received and the artwork has had adequate drying time (approximately two weeks depending on size and medium), the piece will be carefully packed and shipped.
9. Artwork will not be released or shipped until full payment has been received.

Additional Disclaimer

• All timelines are estimates and may vary depending on complexity, drying time, and revision requests.
• Commissions become non-refundable once work has progressed beyond the sketch stage.
• If a commission is cancelled before sketch creation, the artist reserves the right to retain the deposit to cover time and administrative work.
• The client acknowledges and agrees that commissioned artworks may be photographed and shared by the artist for portfolio, marketing, social media, and promotional purposes unless otherwise agreed in writing prior to commencement of the commission.
• The client acknowledges that commissioned artworks are original hand-painted works and that slight artistic interpretation, variations in colour, composition, and style are inherent to the creative process.

G. Refund Policy

Due to the nature of original artwork and fine art prints, returns and refunds are only accepted if the customer receives an incorrect item.

To qualify for a return or refund:

• The Artist must be notified in writing within 48 hours of delivery.
• The customer may be required to provide photographic evidence of the incorrect item.
• The incorrect item must be returned to the Artist in its original condition and packaging.
• The item must be unused and free from any damage, alterations, or signs of wear.

Once the returned item has been received and inspected, the correct item will be shipped or, where replacement is not possible, a refund will be issued.

Returns and refunds are not available for change of mind, incorrect purchases, commissioned works, or custom-made items.

H. Damaged Artwork & Claims

Any damage must be reported within 48 hours of delivery and must include clear photographs of the packaging and artwork. Claims submitted outside this timeframe may not be accepted.

In the case of fine art prints damaged during transit, replacement prints may be provided upon verification of the damage.

As original artworks are one-of-a-kind pieces, replacement may not be possible. Any claims relating to damaged original artworks will be considered on a case-by-case basis.

J. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from the use of this website or the purchase of artwork shall be subject to the jurisdiction of the South African courts.

K. Payments

Full payment is required before any artwork will be dispatched, collected, or released. Ownership of the artwork remains with the artist until payment has been received in full.

L. Privacy Policy

Customer information collected through this website is used solely for the purposes of processing orders, providing customer service, fulfilling legal obligations, and for internal marketing purposes. Personal information will not be sold or shared with third parties except where necessary to complete delivery, process payments, or comply with applicable laws.

M. Order Cancelations

The artist reserves the right to cancel any order and issue a full refund in the event of pricing errors, stock discrepancies, suspected fraudulent activity, or circumstances beyond reasonable control that prevent fulfillment.

N. Force Majeure

The artist is not liable for delays or failure to fulfil orders due to circumstances beyond reasonable control, including but not limited to illness, courier delays, weather events, or other unforeseen disruptions.
